In Greene County district court Bradley Carter Rice, 40, of Rippey was sentenced April 21 after he pleaded guilty to charges of indecent contact with a child and possession with intent to deliver marijuana. On the indecent contact charge, Rice was sentenced to two years in prison. The prison term was suspended and he was placed on probation for two years. The judge also imposed a special sentence of 10 years in prison per Iowa Code 901.5(13) and 903B.2. That sentence is consecutive to the first sentence, and Rice is to begin that sentence as if on parole. He was fined $625 with a $218.75 surcharge. The fine and surcharge were suspended. Rice must pay a $250 civil penalty and he must register on the Iowa Sex Offender Registry.
On the charge of possession of marijuana with intent to deliver, Rice was sentenced to five years in prison, concurrent to the first sentence. The prison term was suspended and he was placed on probation for five years. He was fined $750 with a $262.50 surcharge; both were suspended. He must undergo a mental health evaluation and follow any recommended treatment. He must pay a $125 Law Enforcement Initiative (LEI) surcharge, a $10 surcharge for drug abuse resistance education (DARE), $360 restitution for his court appointed attorney’s fees and $516.72 court costs.
Rice was initially charged with sex abuse-third degree, drug distribution to a person under age 18, and dissemination/exhibition of obscene material to a minor in addition to the indecent contact charge. (Sentencing: Honorable Kurt J. Stoebe)
Patrick Paul Schon, 45, of Glidden was sentenced April 23 after he pleaded guilty to a charge of operating while intoxicated (OWI)-first offense, amended from OWI-third offense. He was sentenced to 48 hours in jail; he may complete an OWI Weekend Offender program in lieu of the jail time. He must also complete a community college drinking driver’s course, and he must undergo a substance abuse evaluation and complete any recommended treatment at his own expense. He was fined $1,250 with a $437.50 surcharge. He must also pay a $10 DARE surcharge and $100 court costs. (Sentencing: Honorable Adria A. Kester)
Joshua Jay Blumbergh, 18, of Grand Junction was sentenced April 21 after changing his plea to guilty to a charge of criminal mischief-second degree aiding and abetting. He was sentenced to five years in prison. The prison term was suspended and he was placed on probation for three to five years. He must reside at a residential correctional facility for 180 days or until he attains the maximum benefit. He was fined $750 with a $262.50 surcharge; the fine and surcharge were suspended. He must pay a $125 LEI surcharge, but the court found him unable to pay any restitution for his court appointed attorney’s fees. He is jointly and severally liable with two other defendants for $1,727.30 victim restitution. (Sentencing: Stoebe)
Zachary James Farrow, 30, of Carroll was sentenced April 21 after he pleaded guilty to charges of OWI-second offense and carrying weapons, amended from carrying a concealed weapon. On the OWI charge, he was sentenced to two years in prison; all but seven days was suspended. He was fined $1,875 with a $656.25 surcharge and a $10 DARE surcharge. He must complete a community college drinking drivers course. On the weapons charge, Farrow was sentenced to two years in prison. The prison term was suspended and he was placed on probation for three years. He was fined $625 with a $218.75 surcharge; both were suspended. A charge of possession of marijuana was dismissed. He must pay $60 restitution for his court appointed attorney’s fees and $100 court costs. (Sentencing: Kester)
Persons pleaded not guilty as follows: Michelle Denise Rader Smith, 42, of Jamaica, possession of marijuana; Alex Duncan Dankel, 20, of Scranton, OWI-first offense and possession of marijuana; and Reyaldo Jose Hernandez, 26, of Perry, driving while license barred. Rader Smith’s trial date was set for May 23. Dankel’s and Hernandez’s trial dates were set for June 24.
Cases were initiated in district court during the week ending April 25 as follows: Timothy James Dunphy, 29, of Duncombe, burglary-third degree – unoccupied motor vehicle, theft-first degree, and criminal mischief-first degree; and Jeremy Scheffers, 19, of Lake City, driving while license revoked.
